Welcome to Nova AI Video Generator! These Terms of Service ("Terms") govern your access to and use of Nova, a mobile application developed by Melih Arik that transforms images and text prompts into AI-generated videos. By downloading, installing, or using Nova, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the application.

1. Acceptance of Terms

By accessing or using Nova AI Video Generator, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Melih Arik. If you are using Nova on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Nova AI Video Generator is an artificial intelligence-powered mobile application that provides the following services:

• Image to Video Conversion: Transform your static images into dynamic 5-second video content using advanced AI technology.
• Text-Guided Generation: Use text prompts to guide the AI in creating videos that match your creative vision.
• AI-Powered Creativity: Leverage cutting-edge artificial intelligence models to generate unique, personalized video content.
• Video Export: Download and share your AI-generated videos across various platforms and social media.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Eligibility

You must be at least 13 years old to use Nova. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use Nova. By using the application, you represent and warrant that you meet these eligibility requirements.

4. User Account and Registration

To access certain features of Nova, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security of your account credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the images and text prompts you upload to Nova ("User Content"). By uploading User Content, you grant Melih Arik a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and display your User Content solely for the purpose of:

• Providing the video generation services.
• Improving our AI models and services (only with anonymized or aggregated data).
• Complying with legal obligations.

5.2 Generated Videos

You own the videos generated by Nova based on your User Content. However, because our AI models are trained on diverse datasets, we cannot guarantee that generated videos will be entirely unique or free from similarities to other content. You are responsible for ensuring that your use of generated videos complies with applicable laws and respects third-party rights.

5.3 Content Representations

By uploading User Content, you represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to use and authorize us to use your User Content.
• Your User Content does not infringe, violate, or misappropriate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
• Your User Content complies with these Terms and all applicable laws and regulations.

6. Prohibited Activities and Content

You agree not to use Nova for any of the following prohibited purposes:

• Illegal content, including child exploitation material, terrorism-related content, or content promoting illegal activities.
• Sexually explicit, pornographic, or adult content.
• Violent, gory, or excessively disturbing content.
• Hate speech, discriminatory content, or content that promotes violence or hatred against individuals or groups.
• Content that harasses, threatens, bullies, or intimidates others.
• Content that infringes on intellectual property rights, including copyrighted images, trademarks, or other protected material.
• Misleading, deceptive, or fraudulent content, including deepfakes intended to deceive or harm others.
• Content depicting or promoting self-harm, suicide, or dangerous activities.
• Spam, malware, or content designed to disrupt or damage computer systems.

6.2 Prohibited Activities

• Attempting to reverse engineer, decompile, or extract the source code of Nova or its AI models.
• Using automated systems, bots, or scripts to access the Service without authorization.
• Attempting to bypass, disable, or interfere with security features or content moderation systems.
• Overloading or attempting to disrupt our servers or infrastructure.
• Impersonating others or misrepresenting your affiliation with any person or entity.
• Collecting or harvesting personal information of other users without consent.
• Using Nova to create content for commercial purposes without appropriate licensing (see Section 7).
• Violating any applicable laws, regulations, or third-party rights.

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of users who engage in prohibited activities. We may also report illegal activities to law enforcement authorities.

7. Subscription Plans and Payment

7.1 Subscription Options

Nova offers various subscription plans to access premium features:

• Free Tier: Limited access to basic features with usage restrictions.
• Weekly Subscription: Full access to all features with weekly automatic renewal.
• Monthly Subscription: Full access to all features with monthly automatic renewal.
• Yearly Subscription: Full access to all features at a discounted rate with annual renewal.
• Lifetime Access: One-time payment for permanent access to all features.

7.2 Payment Terms

All payments are processed securely through Apple's App Store. By subscribing, you agree to:

• Pay the subscription fee at the rate indicated at the time of purchase.
• Automatic renewal of your subscription until you cancel it.
• The pricing and payment terms presented in the App Store at the time of purchase.

7.3 Free Trial

We may offer free trials for certain subscription plans. Free trial offers are subject to specific terms presented at the time of sign-up. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription.

7.4 Refunds and Cancellations

All sales are final, and subscriptions are generally non-refundable except as required by law or as stated in Apple's App Store refund policies. To request a refund, please contact Apple Support directly. You can cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period.

7.5 Changes to Pricing

We reserve the right to change our subscription pricing at any time. Price changes will not affect existing subscribers until their next renewal period. We will provide reasonable notice of any price changes.

8. Intellectual Property Rights

Nova AI Video Generator, including its software, AI models, algorithms, design, logos, and all related intellectual property, is owned by Melih Arik and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use Nova for personal or commercial purposes in accordance with these Terms. This license does not include the right to:

• Copy, modify, or create derivative works of the application.
• Reverse engineer or attempt to extract the source code or AI models.
• Rent, lease, sell, or sublicense access to Nova.
• Remove or alter any copyright, trademark, or proprietary notices.

9. Artificial Intelligence and Content Moderation

9.1 AI Limitations

Nova uses artificial intelligence to generate videos. While we strive for high-quality results, AI-generated content may have limitations:

• Generated videos may not always match your expectations or accurately represent your prompts.
• AI models may occasionally produce unexpected, inconsistent, or imperfect results.
• The quality and creativity of generated videos depend on the quality of your input images and prompts.
• Processing times may vary based on server load and complexity of requests.

We do not guarantee that generated videos will be free from errors, artifacts, or imperfections. You accept these inherent limitations of AI technology.

9.2 Content Moderation

Nova employs automated content moderation systems to prevent the generation of prohibited content. These systems may:

• Block or reject uploads that violate our content policies.
• Prevent the generation of videos containing inappropriate or harmful content.
• Flag potentially problematic content for human review.

Content moderation systems are imperfect and may occasionally produce false positives or false negatives. If you believe your content was incorrectly blocked, please contact us.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Nova, you consent to our data practices as described in the Privacy Policy. Please review our Privacy Policy to understand how we handle your information.

11. Third-Party Services and Links

Nova may contain links to third-party websites, services, or content not owned or controlled by Melih Arik. We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Melih Arik shall not be liable for any damage or loss caused by your use of any third-party services.

12. Disclaimers and Limitations of Liability

12.2 Limitation of Liability

To the maximum extent permitted by law, Melih Arik shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Nova, including but not limited to:

• Loss of profits, revenue, data, or business opportunities.
• Damage to reputation or goodwill.
• Cost of substitute services or products.
• Personal injury or property damage.
• Any damages resulting from AI-generated content, including inaccuracies, errors, or offensive material.

In no event shall Melih Arik's total liability exceed the amount you paid for Nova subscriptions in the twelve (12) months preceding the claim, or $100, whichever is less.

12.3 User Responsibility

You are solely responsible for:

• Your use of Nova and any content you create, upload, or share.
• Ensuring that your use complies with all applicable laws and regulations.
• Any consequences resulting from your violation of these Terms or applicable laws.
• Backing up any important content, as we are not responsible for lost or deleted data.

13. Indemnification

You agree to indemnify, defend, and hold harmless Melih Arik, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of Nova.
• Your violation of these Terms or applicable laws.
• Your User Content or generated videos.
• Your infringement of any third-party rights, including intellectual property, privacy, or publicity rights.
• Any disputes between you and other users of Nova.

14. Termination

14.1 Termination by You

You may terminate your use of Nova at any time by:

• Deleting the application from your device.
• Canceling your subscription through the App Store.
• Requesting account deletion by contacting us.

14.2 Termination by Us

We reserve the right to suspend or terminate your access to Nova at any time, with or without notice, for any reason, including if:

• You violate these Terms or our content policies.
• Your account is inactive for an extended period.
• We suspect fraudulent, abusive, or illegal activity.
• We decide to discontinue the Service.

14.3 Effect of Termination

Upon termination:

• Your right to use Nova will immediately cease.
• We may delete your account data, User Content, and generated videos in accordance with our Privacy Policy.
• You will not be entitled to any refunds unless required by law.
• Sections of these Terms that by their nature should survive termination will continue to apply.

15. Changes to Terms of Service

We reserve the right to modify or update these Terms of Service at any time. When we make significant changes, we will:

• Update the "Effective Date" at the top of this document.
• Notify you through the app, email, or other appropriate means.
• Provide you with an opportunity to review the updated Terms.

Your continued use of Nova after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using Nova and may cancel your subscription.

16. Dispute Resolution and Governing Law

16.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any disputes arising out of or related to these Terms or your use of Nova will be subject to the exclusive jurisdiction of the courts of Turkey. However, we encourage you to contact us first to try to resolve any issues informally.

16.3 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Miscellaneous Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Melih Arik regarding your use of Nova and supersede any prior agreements.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or internet outages.

18. Feedback and Suggestions

We welcome your feedback and suggestions about Nova. If you provide us with any feedback, ideas, or suggestions ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into Nova without any obligation to compensate you.
